SEC Chair Raises Concerns About Token ETF Approval Amidst Crypto Turmoil

Gary Gensler, Chairman of the Securities and Exchange Commission (SEC), has voiced reservations about approving exchange-traded funds (ETFs) tied to tokens like Osmosis (OSMO) and Bonk (BONK) in the U.S. His comments came during a CNBC interview, where he highlighted concerns over transparency and regulatory oversight in the cryptocurrency space.

SEC Concerns Over Token ETFs and Transparency

While acknowledging the significant trading volume seen in these tokens, Gensler emphasized the lack of adequate disclosure required for investors to make informed decisions. “These tokens, whether the ones Jim listed or other tokens, have not given you the disclosures that not only do you need to make your investment decisions, but also are required by the law,” he stated.

The SEC Chair further criticized the practices of crypto exchanges, alleging they operate with a level of deregulation that would be unacceptable in traditional markets. "These crypto exchanges, Jim, are doing things we would never allow this New York Stock Exchange to do. Our laws don’t allow you to trade against your customers,” Gensler asserted.

Regulatory Scrutiny of Crypto Exchanges

He also alluded to the ongoing legal battles surrounding figures in the cryptocurrency industry. While not explicitly naming individuals, his remarks appeared to be directed at Do Kwon, the former CEO of Terraform Labs, who is facing extradition after being arrested in Montenegro. “Some of the leading lights in this field are either in jail, or about to go to jail, or waiting for extradition […] It’s a suboptimal situation for investors. You are investing in a field right now that you are not getting the proper disclosure,” Gensler concluded.

Gensler's comments suggest the SEC remains wary of approving token ETFs until significant improvements are made in terms of transparency, regulatory compliance, and investor protection within the cryptocurrency ecosystem. His concerns come at a time when the industry grapples with ongoing legal challenges and investor distrust stemming from recent high-profile failures.
