Turkey Unveils Crypto Regulations, Prioritizes FATF Compliance and Exchange Oversight

Turkey Unveils Crypto Regulations, Prioritizes FATF Compliance and Exchange Oversight

Turkey's long-awaited cryptocurrency regulations have been presented to the Grand National Assembly, aiming to improve oversight and address concerns raised by the Financial Action Task Force (FATF).

The 19-article draft law prioritizes FATF compliance, a key factor in removing Turkey from the grey list by June 2024. Finance Minister Mehmet Şimşek emphasizes that these regulations are crucial for achieving this goal.

Licensing and Tax Rules for Crypto Exchanges

The law focuses on combating money laundering and mandates licensing for cryptocurrency exchanges. Contrary to some expectations, individual users will not be taxed. Instead, a 2% fee will be levied on exchanges' earnings, with the revenue allocated to regulatory bodies. Taxation of individual trading profits will be addressed in a separate regulation with a minimal expected rate.

Global exchanges face stricter rules, including a ban on advertising in Turkey and a requirement to establish local operations to serve Turkish customers. This mirrors regulatory approaches in the US, where exchanges like Binance have faced penalties. However, Ömer İleri, a lawmaker, clarifies that established local entities of global exchanges can continue operating. This distinction raises concerns about enforcement complexity and the capacity of local regulators to effectively monitor compliance.

Impact on Users and Global Platforms

Key User Implications:

  • Local exchanges must quickly adapt to new licensing requirements.
  • Turkish users may have limited access to global exchanges without local presence.
  • Decentralized wallets and DeFi platforms remain accessible for now.
  • TÜBİTAK, a scientific research body, will have influence over cryptocurrency listings, potentially impacting market dynamics.

Decentralized exchanges and wallets remain unregulated, offering some flexibility for Turkish users. The draft law also addresses asset segregation and embezzlement concerns.

These regulations represent a significant step towards a regulated crypto market in Turkey. While aiming to enhance security and oversight, enforcement details and compliance remain topics of discussion and scrutiny.
