SEC Considers Ethereum a Security, Dampening Hopes for Spot ETFs

The US Securities and Exchange Commission (SEC) may reject applications for spot Ethereum ETFs, citing concerns about Ethereum's status as a security.
This development comes after the SEC issued a notice raising questions about whether ETF proposals for Ethereum properly classify it as a commodity. Analysts believe this indicates the SEC is leaning towards classifying Ethereum as a security, which would significantly complicate the approval process for spot ETFs.
SEC Views Ethereum as Security, Harming ETF Hopes
"The SEC is perhaps considering to deny [applications] based on ETH being a security," said Bloomberg ETF analyst Eric Balchunas. "Our odds of approval remain the same: slim to none."
This news follows a period of mixed signals. The recent removal of staking features from some ETF proposals fueled optimism for approval. However, the SEC's latest stance has caused those hopes to dwindle. The approval chance on prediction market Polymarket dropped from 16% to 13% after the news broke.
Decisions on spot Ethereum ETF applications from Ark Invest, 21 Shares, and Hashdex are expected by May 30th. The potential rejection and ongoing price downtrend have pushed Ethereum's price lower, with some analysts predicting a further decline to $2500 or below.
